Terms of Service

These Terms govern your use of the Gavernor platform and website (the “Service”). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of a business, you confirm you have authority to bind that business. Gavernor is operated by [legal entity name and company number].

1. The Service

Gavernor is a platform that helps UK construction employers find, book and manage temporary workers, and helps workers find work — covering requests, bookings, on-site attendance and digital timesheets. [Confirm Gavernor’s legal role — e.g. employment business / agency / intermediary / technology platform — as this materially affects the parties’ obligations.]

2. Eligibility & accounts

  • You must be 18+ and able to enter a binding contract.
  • You must give accurate information and keep your account details up to date.
  • You are responsible for activity under your account and for keeping your credentials secure.

3. Acceptable use

  • Use the Service only lawfully and for its intended purpose.
  • Do not scrape, reverse-engineer, disrupt, or attempt to gain unauthorised access to the Service or its data.
  • Do not misuse worker or employer personal data obtained through the Service.
  • Employers must meet their legal obligations, including right-to-work checks, health & safety, supervision and applicable employment law.

4. Bookings & the workforce relationship

The Service facilitates bookings between employers and workers. [Set out the nature of the engagement: who employs/engages the worker, responsibility for pay, tax/NICs, CIS, insurance, site safety and supervision, and what Gavernor does and does not warrant about worker availability, suitability or conduct.] Compliance checks shown in the platform are provided as supplied and do not replace your own due diligence.

5. Fees & payment

Fees, charges, margins, invoicing and VAT are as set out in your order or agreed in writing. [Confirm the fee model, payment terms, late-payment and refund position.]

6. Intellectual property

Gavernor and its licensors own all rights in the Service, its software, brand and content. You receive a limited, non-exclusive, non-transferable licence to use the Service per these Terms.

7. Availability & “as is”

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free, and it is provided “as is” except as required by law. [Confirm any service levels.]

8. Liability

Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, [set out exclusions of indirect/consequential loss and an aggregate liability cap].

9. Indemnity

You agree to indemnify Gavernor against claims arising from your breach of these Terms or misuse of the Service. [Confirm scope.]
